Under Texas Law, political subdivisions are not liable in many cases. Under the Texas Tort Claims Act, the municipal government is only liable for:
- Property damage, personal injury, and death proximately caused by the wrongful act or omission or the negligence of an employee acting within his scope of employment if:
- the property damage, personal injury, or death arises from the operation of use of a motor-driven vehicle or motor-driven equipment; and
- the employee would be personally liable to the claimant according to Texas law; and
- Personal injury and death so caused by a condition or use of tangible personal or real property if the governmental unit would, were it a private person, be liable to the claimant according to Texas law.
Article IX Section 9.05 of the City of Keller Charter requires written notice before any claim for injury or damage may be considered.
Section 9.05 Special provision covering damage suits.
Before the city shall be liable to damage claim or suit for personal injury or damage to property, the person who is injured or whose property is damaged, or someone on his/her behalf, shall give the city secretary notice in writing within thirty (30) days after the occurring of the alleged injury or damage, stating specifically in such notice when, where, and how the injury or damage was sustained, and setting forth the extend of the injury or damage as accurately as possible, and giving the names and addresses of all witnesses upon whose testimony such person is relying to establish injury or damage.
