03/05/2024 EDIT: The Keller City Council has approved updates to the Unified Development Code that would impact uses allowed within the Town Center Zoning District as well as spas and medical spas citywide.
Town Center Zoning District Proposals
In the interest of updating Keller's UDC to better reflect the services of our existing businesses in the Town Center Zoning District, account for emerging trends and City Council’s vision for this area of town, and streamline our development processes, city staff has proposed the following changes to the use charts.
On these charts, "P" stands for "permitted," meaning allowed by right and "SUP" stands for "specific use permit," meaning an approval process would be required. You can read more about SUPs below in the Frequently Asked Questions section. You will also notice columns labeled "TC" for the Town Center Zoning District and "TCM" for the Town Center Medical Overlay.
Spa & Medical Spa Proposals
In the interest of better reflecting the services of our existing businesses, accounting for emerging trends in the spa and medical spa industry, and streamlining our development processes, city staff has proposed the following definitions.
- Proposed Spa Definition
An establishment that offers grooming, massage and/or cosmetology services performed by persons licensed to perform those services in Texas and may include the retail sale of goods incidental to the services of the spa.
- Proposed Medical Spa Definition
An establishment that includes spa services and non-invasive medical cosmetic procedures. All medical procedures must be conducted under the supervision of a medical professional licensed in Texas.
Along with new definitions, the proposed changes would require any future Spa or Medical Spa applicant to undergo a Specific Use Permit approval process.
Frequently Asked Questions
- What is a Specific Use Permit?
An SUP allows a business owner to operate within a zoning district where they are not allowed “by right.” This approval process goes through the Planning & Zoning Commission and Keller City Council.
- What happens to existing businesses impacted by the proposed changes?
If these proposed changes to the Unified Development Code are approved, existing Keller businesses impacted by those changes would become "legal nonconforming."
- Does becoming legally nonconforming mean that a business needs to close?
No. In more casual terms, a legal nonconforming business is “grandfathered” as part of proposed updates and would be allowed to continue operating as it does today. A legal nonconforming business could be limited in their ability to expand, however, requiring an additional approval process with the city.
- Can a business go through a Specific Use Permit process to avoid a legal nonconforming status?
Yes. If a business becomes legal nonconforming as part of updates to the Unified Development Code and would prefer not to have legal nonconforming status, city staff would happily guide them through the SUP process. Please note that even if an SUP is denied in this situation, the business would retain its legal nonconforming status and could continue operating as it does today.
- How can I share comments about the proposed changes with city staff and the Keller City Council?
Community Development staff is offering four walk-in dates in early February at Keller Town Hall (1100 Bear Creek Pkwy.) to discuss the proposed changes with impacted businesses and other interested parties, and is available for individual appointments as needed. Comments may be shared with the Keller City Council via email at mayorandcouncil@cityofkeller.com or in person at their March 5, 2024 meeting.
